Terms of Use

Last Updated: August 17, 2026

Welcome to DivePuertoGalera.com (“Dive Puerto Galera,” “we,” “our,” or “us”). By accessing this website, submitting an inquiry, requesting a quotation, making a booking request, or using any service offered or coordinated through this website, you agree to these Terms of Use.

Please read these Terms carefully before making a reservation or participating in any diving, travel, transportation, accommodation, tour, or related activity arranged through this website.

1. About Dive Puerto Galera

DivePuertoGalera.com provides information about scuba diving, dive destinations, dive courses, dive packages, accommodation, transportation, tours, and other travel-related services in Puerto Galera and surrounding areas.

Depending on the service requested, Dive Puerto Galera may assist customers by providing information, preparing quotations, accepting booking requests, coordinating reservations, and connecting customers with independent dive centers, instructors, resorts, hotels, transportation providers, tour operators, boat operators, and other tourism-related businesses.

Unless specifically stated otherwise, the actual diving, accommodation, transportation, tour, or other travel service may be provided by an independent third-party service provider.

2. Acceptance of These Terms

By using this website, submitting an inquiry, making a booking request, or making payment for a service arranged through DivePuertoGalera.com, you acknowledge that you have read, understood, and agreed to these Terms of Use.

If you do not agree with these Terms, please do not use our booking or reservation services.

3. Booking Requests and Confirmations

Submitting an inquiry, booking form, Messenger message, email, or other reservation request does not automatically guarantee a confirmed reservation.

A booking is considered confirmed only after availability has been verified and any required payment, deposit, or other booking requirement has been completed.

Availability may change without notice until a reservation has been confirmed. Customers are responsible for checking the details of their booking confirmation, including names, dates, schedules, number of guests, and services included.

4. Prices and Quotations

Prices displayed on DivePuertoGalera.com are provided for general information and may change due to availability, season, supplier rates, fuel costs, government fees, transportation costs, exchange rates, or other circumstances.

The price stated in a specific confirmed quotation or booking confirmation will normally apply to that reservation, subject to the conditions stated in the quotation or confirmation.

Unless expressly stated as included, customers are responsible for expenses such as meals, entrance fees, environmental fees, equipment rental, transportation, port fees, tips, personal expenses, and other charges not specifically included in a package.

5. Payments and Deposits

Certain reservations may require full payment or a deposit before confirmation. Payment instructions and requirements will be provided during the booking process.

Payments may be made to Dive Puerto Galera or directly to an independent service provider, depending on the particular booking arrangement.

Customers are responsible for ensuring that payment and transaction information submitted to us is accurate.

Bank charges, transfer charges, payment processing fees, currency conversion costs, or other payment-related charges may be the responsibility of the customer unless otherwise stated.

6. Cancellations, Changes and Refunds

Cancellation, rebooking, and refund conditions may vary depending on the dive center, resort, hotel, transportation operator, tour provider, or other supplier involved in the reservation.

Customers should review the cancellation and refund conditions provided with their quotation or booking confirmation before making payment.

Where a third-party supplier has a non-refundable or partially refundable policy, the same restriction may apply to the customer's booking.

Any approved refund may be subject to deductions for non-refundable supplier charges, bank charges, payment processing fees, administrative expenses, or services already provided.

No refund is guaranteed solely because a customer changes plans, arrives late, fails to appear, or voluntarily chooses not to use a confirmed service.

7. Weather and Sea Conditions

Scuba diving, snorkeling, boating, island activities, and marine transportation are affected by weather, sea conditions, visibility, currents, tides, government restrictions, and other circumstances that may change without notice.

Dive sites, schedules, boats, departure times, itineraries, or planned activities may therefore be changed, postponed, substituted, or cancelled when necessary for safety, operational, weather, or regulatory reasons.

Safety decisions made by the dive operator, boat captain, dive professional, local authorities, or other responsible personnel must be respected.

8. Risks Associated With Diving

Scuba diving, freediving, snorkeling, swimming, boating, and other water activities involve inherent risks.

These risks may include, but are not limited to, decompression illness, barotrauma, equipment-related incidents, marine-life encounters, currents, waves, slips, falls, boat-related incidents, drowning, injuries, and other medical emergencies.

Participation in any diving or water activity is voluntary and subject to the safety requirements, medical requirements, waivers, procedures, and instructions of the dive center, instructor, divemaster, boat operator, or other provider conducting the activity.

9. Medical Fitness for Diving

Customers are responsible for determining whether they are medically fit to participate in scuba diving or other requested activities.

A dive center or dive professional may require completion of a medical questionnaire or clearance from a physician before allowing a customer to participate.

Customers must honestly disclose relevant medical conditions, medications, recent illnesses, injuries, or other information requested by the dive professional or operator.

Dive Puerto Galera does not provide medical advice and does not determine whether a person is medically fit to dive.

10. Diving Certification and Experience

Certified divers may be required to present a valid certification card or other acceptable proof of certification before participating in certain dives.

Certain dive sites or activities may require minimum certification levels, recent diving experience, a check dive, specific training, or approval from the dive operator.

The dive operator has the right to modify or refuse a dive when, in its professional judgment, a diver's certification, experience, physical condition, behavior, equipment, or ability is not appropriate for the planned activity.

11. Dive Courses

Participation in scuba diving courses is subject to the requirements and standards of the applicable dive center and diving certification or training organization.

Completion of a course and issuance of certification are not automatically guaranteed. Participants must successfully complete the applicable academic, confined-water, open-water, skills, medical, and performance requirements.

12. Diving Equipment

Rental equipment availability, type, brand, model, and size may vary. Customers should inspect rental equipment and immediately report any concern to the dive operator before using it.

Customers using their own diving equipment are responsible for ensuring that it is properly maintained, suitable, and appropriate for the planned activity.

Additional charges may apply for lost, damaged, or negligently handled rental equipment, subject to the policies of the applicable service provider.

13. Independent Service Providers

Dive Puerto Galera may arrange, recommend, or coordinate services provided by independent businesses, including dive centers, instructors, resorts, hotels, ferry companies, boat operators, transportation providers, tour operators, and other tourism-related businesses.

These providers operate independently and may maintain their own terms and conditions, cancellation policies, safety procedures, waivers, operating rules, and privacy practices.

When a service is provided by an independent third party, that provider is responsible for the actual operation and delivery of its service.

14. Transportation and Travel Schedules

Ferry, boat, van, bus, and other transportation schedules may change because of weather, sea conditions, mechanical issues, port restrictions, government orders, operational requirements, traffic conditions, or other circumstances beyond our control.

Customers are responsible for allowing adequate travel time when connecting between ferries, flights, buses, tours, dive activities, and other transportation.

Dive Puerto Galera cannot guarantee that an independent transportation provider will depart or arrive at an exact scheduled time.

15. Accommodation

Hotel and resort descriptions, photographs, room categories, facilities, and amenities are provided for general reference and may be changed by the accommodation provider.

Check-in, check-out, cancellation, security deposit, extra guest, and property rules are determined by the applicable hotel or resort.

16. Customer Responsibilities

Customers are responsible for:

  • Providing complete and accurate booking information;
  • Checking names, dates, schedules, and other booking details before confirmation;
  • Arriving at the designated meeting or departure point on time;
  • Following safety instructions and applicable laws and regulations;
  • Following instructions given by dive professionals, boat crews, guides, and service providers;
  • Obtaining any required identification, permits, certifications, or travel documents;
  • Providing information required for safe participation in diving activities;
  • Taking reasonable care of personal belongings and rented equipment; and
  • Behaving responsibly toward staff, other guests, local communities, marine life, and the environment.

17. Late Arrivals and No-Shows

Customers must arrive at the designated meeting or departure point at the time specified in their booking confirmation.

Late arrival may result in a missed ferry, transfer, tour, dive, boat departure, or other scheduled service.

A missed service resulting from late arrival or failure to appear may be considered a no-show and may not qualify for a refund.

18. Personal Belongings

Customers are responsible for their passports, identification cards, money, mobile phones, cameras, diving equipment, luggage, valuables, and other personal belongings.

We recommend keeping valuables secure and checking belongings before leaving boats, vehicles, hotels, dive centers, and activity locations.

19. Travel and Diving Insurance

Customers are strongly encouraged to obtain appropriate travel insurance and, where applicable, scuba diving accident insurance before participating in diving activities.

Insurance should be selected according to the customer's individual travel plans, activities, medical circumstances, and desired level of protection.

20. Force Majeure and Events Beyond Our Control

Dive Puerto Galera will not be responsible for failure, delay, alteration, or cancellation caused by circumstances reasonably beyond our control or the control of the applicable service provider.

Such circumstances may include severe weather, typhoons, rough seas, natural disasters, earthquakes, flooding, fires, epidemics, public health emergencies, strikes, transportation disruptions, mechanical failures, power interruptions, government orders, port closures, civil disturbances, or similar events.

When reasonably possible, efforts may be made to assist customers with alternative arrangements, subject to availability and the policies of the applicable service providers.

21. Accuracy of Website Information

We make reasonable efforts to keep information on DivePuertoGalera.com accurate and current. However, prices, schedules, photographs, descriptions, availability, dive-site information, and other website content may change without prior notice.

Website content is provided primarily for general information and should not be considered a guarantee of current availability, schedules, pricing, weather, or diving conditions.

22. Intellectual Property

Unless otherwise stated, original text, graphics, logos, website design, and other original content appearing on DivePuertoGalera.com may not be copied, reproduced, republished, or commercially distributed without permission.

Some photographs, logos, trademarks, videos, or other materials displayed on the website may belong to independent dive centers, resorts, photographers, tourism providers, or their respective owners.

23. External Websites

DivePuertoGalera.com may contain links to external websites, social media services, dive centers, resorts, transportation providers, and other third-party services.

We are not responsible for the content, availability, security, terms, or privacy practices of independent third-party websites.

24. Privacy

Personal information submitted through DivePuertoGalera.com is handled in accordance with our Privacy Policy and applicable Philippine privacy requirements.

Please review our Privacy Policy for additional information regarding how personal information may be collected, used, stored, and disclosed.

25. Limitation of Liability

To the extent permitted by applicable law, Dive Puerto Galera shall not be liable for indirect, incidental, special, or consequential loss resulting from circumstances outside our reasonable control.

Where an independent service provider actually delivers a diving, transportation, accommodation, tour, or other service, claims relating to the operation or delivery of that service should ordinarily be directed to the responsible service provider.

Nothing in these Terms of Use is intended to exclude or limit any responsibility, consumer protection, right, or remedy that cannot legally be excluded or limited under applicable law.

26. Refusal or Termination of Service

A booking or service may be refused or terminated when reasonably necessary because of safety concerns, fraudulent activity, abusive or threatening behavior, violation of law, failure to follow safety instructions, non-payment, or serious violation of these Terms or the applicable service provider's rules.

27. Changes to These Terms

We may revise these Terms of Use from time to time to reflect changes in our services, suppliers, website, operating procedures, or applicable requirements.

The revised Terms will take effect when published on DivePuertoGalera.com, unless otherwise stated.

28. Governing Law

These Terms of Use shall be interpreted in accordance with the applicable laws of the Republic of the Philippines.

Nothing in these Terms limits any mandatory rights or remedies available to consumers under applicable Philippine law.
